By using "The Meal Planner App" (hereinafter referred to as the "App"), you agree to these Terms of Service (TOS). Please read them carefully. If you do not agree to these terms, you may not use the App.
1. Overview of the Service
The Meal Planner App is designed to assist users with meal planning, recipe searches, recipe storage, and generating grocery lists based on selected meals. While we provide tools to simplify meal preparation, users must use their judgment when selecting recipes and creating meal plans.
The App is licensed, not sold, to you for use on Apple-branded devices that you own or control, and as permitted by the Usage Rules set forth in the App Store Terms and Conditions. The license is nontransferable and limited to personal use.
2. User Responsibilities
You are responsible for ensuring the accuracy and safety of the meals you prepare. The App pulls recipes from third-party sources, and Fresh Field, LLC is not liable for the accuracy, completeness, or safety of these recipes. We recommend users verify all ingredient lists and nutritional information.
By using the App, you consent to the collection of technical data and related information, including but not limited to device, system, and app usage data. This information is used to improve the App and deliver relevant updates and services.
3. Limitation of Liability
Fresh Field, LLC shall not be held liable for any personal injury, illness, or damages resulting from the use of recipes or meal plans provided through the App. You agree to use your best judgment when preparing meals and to ensure proper food handling and cooking practices.
To the maximum extent permitted by law, Fresh Field, LLC’s total liability for any damages shall not exceed the amount you paid for the App or $50, whichever is greater.
The App is provided "as is" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or noninfringement. Fresh Field, LLC does not guarantee uninterrupted or error-free operation of the App.
4. Intellectual Property and Content Ownership
While you retain ownership of any content you create, such as recipes, by uploading it to the App, you grant Fresh Field, LLC a worldwide, non-exclusive, royalty-free license to use, share, and display this content within the App. This allows us to share user-generated recipes with others for the betterment of the App experience.
You may not copy, modify, distribute, or reverse-engineer any part of the App, except as permitted by applicable law.
5. Subscription and Payment Terms
The Meal Planner App operates on a subscription-based model, with the subscription amount subject to change. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. After the free trial, you will be charged the subscription fee unless you cancel.
Subscriptions are managed through Apple or Google Play services, and refunds or cancellations are subject to their respective policies. Users are responsible for managing their subscriptions directly through these platforms.
6. Notifications and Alerts
By using the App, you agree to receive alerts and notifications related to your meal planning activities. These notifications may include reminders, updates, and promotional content. You can manage notification preferences in your device settings.
7. Third-Party Services
The Meal Planner App may provide access to third-party services or content. Fresh Field, LLC is not responsible for the accuracy, availability, or safety of these third-party services. Use of third-party content is at your own risk.
The App may also enable access to external websites or services. Fresh Field, LLC disclaims responsibility for evaluating or guaranteeing the content, accuracy, or availability of these services.
8. Export Compliance
You may not use or otherwise export or re-export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained. By using the App, you represent and warrant that you are not located in any embargoed country or on any restricted party list.
9. Governing Law
These Terms shall be governed by the laws of the United States and the state in which Fresh Field, LLC operates. Any disputes arising from these terms shall be resolved in a competent court within the United States.
10. Termination
You may terminate your account at any time. Fresh Field, LLC reserves the right to terminate accounts that violate these Terms of Service or engage in inappropriate behavior.
Upon account deletion, all user data, including recipes, grocery lists, and meal plans, will be permanently deleted and cannot be recovered.
11. Changes to the Terms
We reserve the right to modify these Terms of Service at any time. Users will be notified of any significant changes, and continued use of the App signifies acceptance of the updated terms.
